Understanding the Key Differences between Education and Work Visas in Thailand

Navigating the visa landscape in Thailand can be complex, especially when it comes to understanding the distinctions between an education visa (Non-Immigrant ED visa) and a work visa (Non-Immigrant Visa “B”). Whether you’re planning to study or work in the Land of Smiles, it’s essential to grasp the key differences between these two types of visas to ensure a smooth and lawful stay.

Here’s a breakdown of the fundamental disparities between an education visa and a work visa for foreigners in Thailand.

Purpose

  • Education Visa (Non-Immigrant ED visa)

This visa category caters to individuals seeking full-time education, internships, or training opportunities in Thailand’s private and public educational institutions. It is also applicable for internships and training as part of an academic curriculum or in governmental and international organizations. Moreover, it encompasses various educational programs, such as Thai language courses or traditional Thai boxing classes from legitimate institutes which are approved by the Ministry of Education and school.

  • Work Visa (Non-Immigrant B visa)

Designed for those intending to enter Thailand for business purposes, attending conferences, or seeking employment with salary. This visa category is specifically tailored to accommodate individuals who will engage in professional activities requiring compensation.

Documentation Requirements

  • Education Visa

To obtain an education visa, applicants typically need to provide documentation demonstrating enrollment in a recognized educational institution in Thailand. This includes acceptance letters, course details, and proof of enrollment. For internship purposes, additional documentation such as an official internship offer, recommendation letters, student ID, academic records, and acceptance letters from the hosting organization. It’s important to note that specific document requirements may vary depending on the type of educational institution and the embassy or consulate outside Thailand where the application is submitted.

  • Work Visa

Applicants for a work visa must furnish documents related to employment, such as a job offer, employment contract from a Thai employer, corporate documents, and evidence of professional qualifications and work experience. Additionally, a valid work permit or an approval letter from the Department of Employment regarding the “WP3” form submitted by the employer on behalf of the applicant are necessary.

Remarks:

  • Some nationalities like Indians, Chinese, Pakistanis, Sri Lanka, Middle Eastern and African will need to apply for an education visa or work visa from their home country.
  • Some nationalities are eligible to  apply for E-visa (Electronic visa). You can check the specific details and eligibility criteria on this website:: https://www.thaievisa.go.th/
  • If the student expresses a lack of interest in pursuing studies in Thailand, the school and My internship Asia are unable to provide support for the acquisition of an ED visa.

Duration and Stay Period

  • Education Visa

The Education Visa allows for a single entry into Thailand within 3 months from the date of application. Holders of the ED visa are permitted to stay in Thailand for a duration of up to 90 days. For individuals requiring multiple entries, a re-entry permit can be obtained from a Thai Immigration Office or International Airport. The fees for re-entry permits are 1,000 Baht for a single re-entry and 3,800 Baht for a multiple re-entry permit.

  • Work Visa

For single-Entry, this visa type permits entry into Thailand once within 3 months from the date of application, with a maximum stay period of up to 90 days. For multiple-Entry (only available for conducting business), this valid for entering Thailand multiple times within 1 year from the date of application, each visit allowing a stay of up to 90 days.

Work Authorization, Renewal and Extension

  • Education Visa

Holders of an education visa are not permitted to engage in paid work in Thailand. Any form of employment without the proper work permit is considered illegal. However, for internship purposes, full-time or limited work activities related to the internship are allowed, if they do not involve paid employment. Education visas can typically be renewed and extended as long as the individual continues to meet the educational requirements. However, for internship purposes, visa renewal and extension are limited by the specified duration of the internship program.Visa renewal is acceptable outside Thailand. Students cannot extend a stay more than 1 year (12 months) each visa for private school such as Language school. Some schools offer a stay permit more than 12 months, which means you have to apply for a new ED visa outside Thailand.

  • Work Visa

A work permit visa authorizes the holder to work and receive payment for specific employment positions designated in the work permit. The visa is renewable and extendable as long as the employment remains ongoing, and the employer complies with relevant regulations regarding employment and work permits in Thailand.
